Nestlé Poland faces court action over alleged greenwashing

Share

Key facts:

Environmental charity ClientEarth has initiated civil proceedings against Nestlé Poland in the Warsaw Regional Court over claims of greenwashing in relation to the packaging of the Nałęczowianka bottled water.

ClientEarth initiated the action on 17 September 2025 after negotiations between the parties failed to reach an agreement. ClientEarth’s complaint relates specifically to the packaging of bottles and multipacks of Nałęczowianka bottled water, which uses slogans such as “I am 100% made of recycled PET plastic* (*not applicable to the cap and the label),” “I am made from another bottle,” and “I am recyclable.” The complaint filed by ClientEarth alleges these statements give consumers the false impression that the single-use plastic products have no environmental impact. ClientEarth is seeking an order to prevent Nestlé Poland from using the ‘misleading’ labelling.

ClientEarth refers to a survey conducted by Ipsos on its behalf to indicate how the identified slogans are misleading the consumer population. The survey revealed a clear gap between consumer perceptions and the environmental reality of how plastic packaging was managed after it was disposed of by the consumer.
