Over the past few years we have been involved in a number of trust disputes, many with an international dimension. We have experience acting for and against trustees.

Services

We can advise where claims are being made against trustees or where information is being sought about the trust and its assets.  We have experience of contested Beddoes applications.

We also act against trustees where breach of trust and misconduct are alleged.

We have acted in a number of family disputes concerning trust beneficiaries and seek to resolve these through negotiation or mediation where possible.

In our asset tracing work, we often set aside sham trusts in order to secure assets which have been placed within them. This can be particularly difficult in some offshore jurisdictions so we work closely with leading practitioners in a number of jurisdictions to assist in this.

We regularly deal with complicated issues of constructive trusts relating to the proceeds of fraud.
