Key Facts:

New Jersey Attorney General and Department of Environmental Protection (DEP) Acting Commissioner announced the judicial approval of two settlements valued at approximately US$2.5 billion to resolve litigation against DuPont-related entities and 3M concerning PFAS (“forever chemicals”) contamination, pollution at four industrial sites, and contamination linked to aqueous film-forming foam (AFFF).

The DuPont settlement itself, valued at US$2 billion, is the largest environmental settlement ever secured by a single US state.

The settlements resolve several lawsuits relating to statewide PFAS contamination and environmental damages. US$365 million of the settlement fund will be allocated to natural resource restoration projects, while additional amounts will support PFAS abatement and contamination remediation.
