Largest UK environmental pollution claim issued following Welsh river pollution

Key facts:

Almost 4,000 people have commenced a class action lawsuit against Welsh Water and major Welsh poultry producers following allegations of “extensive and widespread pollution” in the rivers Wye, Lugg and Usk.

The claimants allege that the three rivers have been polluted by:

  • Avara Foods intensive poultry farming operations. It is alleged that these operations have caused phosphorus-rich manure to be spread on the fields which consequently run-off into the rivers.
  • Sewage spills into the rivers by Welsh Water.

River pollution, including a high concentration of phosphates, can damage wildlife and the surrounding ecosystem. The claimants also allege the pollution is causing a reduction in property values in the area and financial loss for local businesses. The legal claim seeks the following relief: (i) accountability by the defendants for the impact of their operations/actions; (ii) to stop the pollution and restore the health of the rivers; and (iii) to compensate for the damage caused and deter from future pollution.

Avara Foods share concerns over the condition of River Wye but claim in a statement to the BBC that no manure is stored or spread on poultry-only farms that supply Avara Foods. Welsh Water have also said that they have made “significant investments over recent years”, achieving “real improvements in water quality”. Both companies intend to defend the claims against them.
