Partner and Head of Business Crime Nick Vamos has been quoted by the BBC, Financial Times and Reuters on legal proceedings brought by Andrew Mountbatten-Windsor challenging the search warrants used by Thames Valley Police following his arrest earlier this year.
In his comments, Nick explained that even if a court were to quash the original search warrants, it would not necessarily prevent investigators from retaining material obtained during the searches. He noted that where a warrant is challenged on technical grounds, police may be able to apply to the court to retain seized material if there are grounds for it to be lawfully seized again.
Nick also outlined the distinction between technical defects in the warrant process and more fundamental issues affecting the legality of the searches, explaining that the practical impact of a successful challenge may depend on the nature of the flaw identified by the court.
