It’s been five years since deferred prosecution agreements (DPAs) were introduced in the UK and the Serious Fraud Office (SFO) has only successfully concluded four. Lisa Osofsky, the director of the SFO has stated that she would like to see some of the powers wielded by US prosecutors, including the ability to strike DPAs with individuals. Partner Maria Cronin commented that people might find a DPA to be an attractive way of avoiding lengthy, expensive and unpredictable criminal proceedings, especially where they are keen for a clean break from previous corporate misconduct and wish to preserve their professional integrity.
