Business Crime partner, Hannah Laming comments on the surprise judgment handed down by the Supreme court for case Financial Conduct Authority v Macris. The court ruled that the FCA didn’t identify JP Morgan Executive in the London Whale scandal.

Hannah comments that “This will be a disappointing decision for some. It will do little to check the tendency on the part of the regulator and firms to reach swift settlements in which the underlying facts are not subject to rigorous challenge, at the expense of procedural rights for individuals caught up in regulatory investigations”.
