Banking Litigation

Claims against banks for mis-selling or wrongly pricing products or for improperly withdrawing agreed credit lines or margin facilities are becoming ever more common following the global financial crisis.

We have widespread experience of litigating on behalf of banks and, when appropriate, against them, both within and outside the UK.

International Litigation

Our cases involve disputes all over the world, including Europe, the USA, the Far East, South America, the Caribbean and Africa.

We have an extensive network of lawyers in other jurisdictions and close and ongoing relationships with many of the leading law firms and specialists in other countries.

Litigation Funding

The costs of litigation can be substantial and if you lose you may well be liable for a large portion of your opponent’s costs.  In some cases, this is seen as a reason not to litigate.

We take the view that good cases should not be abandoned, or less specialist lawyers instructed, simply on the basis of costs. We are always willing to work with clients to investigate the various funding options that are available such as:

  • Insurance: this may be available under existing policies and we can advise on cover and working with insurers.
  • After the event insurance: this may be bought to protect your potential liability for the other side’s costs.
  • Conditional Fee Arrangements (CFA): we may act under a CFA which means we would agree a discounted rate and receive an enhanced payment if successful.
  • Third party funding: this is available for some cases and means a third party takes on the cost of the litigation on the basis that it will share any recoveries.
