Peters & Peters acted for the CEO and managing director of one of the largest chemical producers in the world following a request for their extradition for offences of fraud, tax evasion of more than £5 million and money laundering.
We analysed the tax offences which were essentially allegations of transfer pricing to allow sale at an undervalue to a connected party. We demonstrated that these allegations were without merit by showing that the products were sold at market price and were not sold to a connected company.
These allegations were all made for political reasons in an attempt to secure the hostile takeover of the company and we provided compelling expert evidence to prove this and that there was no prospect of a fair trial for our clients if extradited.
In 2009 the extradition proceedings were stopped on the basis that the prosecution was politically motivated and that there was no prospect of a fair trial if extradition took place.
